Yetter Coleman filed a petition for certiorari at the U.S. Supreme Court on behalf of Rosa Jimenez, asking the high court to define what standard of review applies to claims of actual innocence brought under the Due Process Clause of the Fourteenth Amendment. Jimenez, who was convicted of killing a child in her care, sought a new trial on the basis of newly available opinions of medical experts that disputed the Texas state’s trial evidence as unreliable and speculative, as well as ineffective assistance of her counsel at trial. After a state district court recommended that she be granted a new trial, the Texas Court of Criminal Appeals reversed, and Yetter Coleman agreed to take her case to the Supreme Court.
