Texas Court Certifies FLSA Class Represented by Yetter Coleman

On August 10, a Texas federal court certified two classes of home mortgage consultants (HMCs) who claim that their employers – two major banks – failed to pay them overtime compensation in violation of the Federal Labor Standards Act.  Among other rulings, the Court held that Rule 23 class action standards adopted by the Supreme Court in Wal-Mart Stores Inc. v. Dukes do not apply to FLSA conditional certification cases.  Yetter Coleman was designated as co-lead counsel in this consolidated proceeding in late 2011.
