Amy Farish and Katie Tipper-McWhorter Analyze AI Impacts on Valuation and Damages in Civil Litigation for State Bar of Texas Conference

While much of the discussion about the use of artificial intelligence (AI) in the legal field has centered on ethics, hallucinated citations or judicial sanctions, the new technology is also impacting case valuations and damages calculations.

In an article published for the State Bar of Texas 18th Annual Damages in Civil Litigation Conference in early February, partner Amy Farish and senior counsel Katie Tipper-McWhorter detail how insurers, damages experts and mediators are already using AI to assess cases.

Farish and Tipper-McWhorter write that insurance companies are increasingly using AI to analyze medical records, financial documents and prior case outcomes, as well as generate settlement ranges and accelerate claim reviews. They also note that AI adoption and use by damages experts is already widespread.

For alternative dispute resolution, Farish and Tipper-McWhorter discuss how mediators use AI to conduct legal research, summarize case law and analyze legal issues. Their article concludes with a review of the regulations and guidelines governing AI use in the legal profession, including disclosure.

Farish’s practice focuses on commercial litigation and includes representing clients in a diverse range of matters, including class-action securities disputes, intellectual property, and complex contract issues.

Tipper-McWhorter represents clients in cases involving alleged breaches of contract, breaches of fiduciary duty, fraud, misrepresentation, nondisclosure agreements, trade secrets and noncompete agreements.
